B&H Warranty
B&H FURNITURE SYSTEMS, INC. (B&H) warrants its products to be free from
defects in material and workmanship for a period of five (5) years from the
date of initial delivery. B&H obligations and the purchaser's remedy
pursuant to this warranty are limited to repair or replacement, at the B&H
option, f.o.b. the B&H plant, of products which, when used normally, proved
to be defective within the period stated. B&H makes no warranties to
purchasers for personal, family or household purposes. THERE ARE NO OTHER
WARRANTIES EXCEPT AS EXPRESSLY SET FORTH ABOVE, EITHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. The remedies stated herein are expressly agreed to be exclusive as a condition of sale and B&H's liability with respect to its products or installation services shall not exceed that expressly set forth above irrespective of the theory upon which any claim might be based, including breach of contract, warranty, negligence or strict liability in tort. Under no circumstances shall B&H be liable for any incidental or consequential
damages.
